Terms of Service - YTong Chinese Learning App

Please read these Terms of Service carefully before using the YTong Chinese Learning App.
1. Acceptance of Terms
By accessing or using the YTong Chinese Learning App ("the App"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our App.
These Terms constitute a legally binding agreement between you and Xiamen Shiyi Kunze Culture Technology Co., Ltd. regarding your use of the YTong application.
2. Age Restriction
To use YTong, you must meet the following requirements:
- You are at least 13 years of age
- You have the legal capacity to enter into these Terms
- You are not prohibited from receiving our services under applicable laws
Age Restriction: YTong is not intended for children under 13 years of age. If you are under 13, you may not use or register for the App. If you are between 13 and the age of majority in your jurisdiction, we recommend that you review these Terms with your parent or legal guardian to ensure they understand and agree to them.
By creating an account, you represent and warrant that you meet all eligibility requirements, including the age requirement of at least 13 years.
3. Account Registration and Profile
To access certain features, you may need to register for an account:
- You must provide accurate and complete registration information
- You are responsible for maintaining the confidentiality of your account credentials
- You agree to notify us immediately of any unauthorized use of your account
- You are responsible for all activities that occur under your account
Profile Customization
YTong offers profile customization features:
- You can set and modify a custom nickname that will be displayed in the app
- You can upload a profile picture from your device's photo gallery
- When you choose to upload a profile picture, you grant us permission to store and display it as your profile picture
- You are responsible for ensuring you have the right to use any images you upload
- You can modify your nickname and profile picture at any time through the app settings
- Access to your photo gallery is requested only when you choose to change your profile picture
We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or use inappropriate profile content.
4. License to Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on your personal devices
- Use the App for your personal, non-commercial educational purposes
- Access the learning content and features provided through the App
- Customize your profile with nicknames and profile pictures
This license does not include any right to:
- Copy, modify, or distribute the App or its content
- Use the App for any commercial purpose
- Reverse engineer, decompile, or disassemble the App
- Remove any proprietary notices or labels
- Use the App in any manner that could damage, disable, overburden, or impair our services
5. User Content and Profile Customization
YTong allows you to create and customize your learning profile:
- You retain ownership of any personal content you create, including profile pictures
- You grant us a license to use, store, and process your content to provide the service
- You are solely responsible for the content you create and upload
- We may remove content that violates these Terms or applicable laws
Profile Content Guidelines
When customizing your profile, you agree not to:
- Use profile pictures that contain offensive, obscene, or inappropriate content
- Use nicknames that are offensive, impersonate others, or violate third-party rights
- Upload images that you do not have the right to use
- Include personal information of others without their consent
- Use profile features to harass, threaten, or intimidate other users
Regarding audio recordings: Any voice recordings made through the pronunciation features are processed locally on your device and are not stored on our servers. We do not claim any ownership rights to your voice recordings.
6. Prohibited Activities
When using YTong, you agree not to:
- Use the App for any illegal or unauthorized purpose
- Violate any laws, regulations, or third-party rights
- Interfere with or disrupt the App's functionality
- Attempt to gain unauthorized access to our systems
- Use automated means to access the App without our permission
- Share your account credentials with others
- Impersonate any person or entity
- Upload malicious code or viruses
- Misrepresent your age or identity
- Use inappropriate content in your profile customization
- Harass, bully, or intimidate other users through profile features
7. Termination
These Terms remain in effect while you use our App. We may terminate or suspend your account:
- If you violate these Terms of Service
- If we suspect fraudulent or abusive activity
- If required by law or legal process
- If we discover you do not meet the age requirement
- If you use inappropriate profile content
- For any other reason at our discretion
Upon termination, your right to use the App will immediately cease. You may also terminate your account at any time by contacting us or through account settings.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will meet your specific requirements
- The App will be uninterrupted, timely, secure, or error-free
- The results that may be obtained from using the App will be accurate or reliable
- Any errors in the App will be corrected
- The App will be compatible with all devices or operating systems
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL XIAMEN SHIYI KUNZE CULTURE TECHNOLOGY CO., LTD., ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of or inability to access or use the App
- Any conduct or content of any third party on the App
- Any content obtained from the App
- Unauthorized access, use, or alteration of your transmissions or content
- Issues related to profile customization features
THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS.
10. Changes to Terms
We reserve the right to modify these Terms at any time:
- We will provide notice of material changes through the App or via email
- Your continued use after changes constitutes acceptance of the revised Terms
- If you disagree with the changes, you may terminate your account
- The "Last Updated" date at the top indicates when revisions were made
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in Xiamen, China.
